1. Introduction & Acceptance

Welcome to Artfelt Therapy. These Terms of Service ("Terms") govern your use of our website artfelt.in and our therapy, counseling, and workshop services ("Services") provided by Divya Batra Masiwal ("Therapist," "we," "our," or "us").

By accessing our website or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

These Terms are governed by the laws of India, including the Indian Contract Act, 1872, the Consumer Protection Act, 2019, and the Information Technology Act, 2000.

2. Description of Services

Artfelt Therapy provides:

• Individual Therapy: Art psychotherapy and counseling sessions (online and in-person in Mumbai)
• Workshops: Art therapy workshops for individuals, groups, and organizations
• Life Coaching: Creative life coaching sessions
• Digital Products: Planners, guides, and other therapeutic resources

Important: Our services are therapeutic in nature but are not a substitute for emergency medical care or psychiatric treatment. If you are experiencing a mental health emergency, please contact emergency services or a crisis helpline immediately.

3. Eligibility

To use our Services, you must:

• Be at least 18 years of age, or have parental/guardian consent if under 18
• Have the legal capacity to enter into a binding agreement
• Provide accurate and complete information when booking services
• Not use our services for any unlawful purpose

4. Booking & Payments

4.1 Booking Process

Sessions can be booked through our website. Upon booking, you will receive a confirmation email with session details. Booking a session constitutes your acceptance of these Terms.

4.2 Payment Terms

• All fees are listed in Indian Rupees (INR) and are inclusive of applicable taxes
• Payment is required at the time of booking unless otherwise agreed
• Payments are processed securely through Razorpay
• We accept UPI, credit cards, debit cards, and net banking

4.3 Session Fees

Current session fees are displayed on our website. We reserve the right to modify fees at any time; however, any changes will not affect already-booked sessions.

5. Cancellation & Refund Policy

5.1 Client Cancellations

• 48+ hours notice: Full refund or reschedule at no additional cost
• 24-48 hours notice: 50% refund or reschedule with 50% fee for next session
• Less than 24 hours or no-show: No refund; full session fee forfeited

5.2 Therapist Cancellations

If we need to cancel a session, you will receive a full refund or the option to reschedule at your convenience. We will provide as much notice as possible.

5.3 Refund Processing

6. Session Guidelines

6.1 Session Duration

Sessions are scheduled for the duration specified at booking. Please arrive on time. Late arrivals will not extend the session time.

6.2 Online Sessions

• Ensure a stable internet connection and private, quiet space
• Video call links will be provided before the session
• Technical difficulties on the client's end do not warrant refunds

6.3 In-Person Sessions (Mumbai)

• Location details will be provided upon booking confirmation
• Please inform us of any accessibility requirements in advance

7. Confidentiality

All information shared during therapy sessions is strictly confidential. However, confidentiality may be breached in the following circumstances as required by law and professional ethics:

• Imminent risk of harm to yourself or others
• Suspected child abuse or abuse of vulnerable adults
• Court orders or legal requirements
• With your written consent for specific disclosures

8. Limitations of Services

8.1 Not Emergency Services

8.2 No Guarantees

While we are committed to providing high-quality therapeutic services, we cannot guarantee specific outcomes. Therapy is a collaborative process, and results depend on many factors including client engagement.

8.3 Medical Disclaimer

Our services complement but do not replace medical or psychiatric treatment. If you are taking medication or under psychiatric care, please continue your treatment and inform your healthcare provider about your therapy sessions.

9. Intellectual Property

All content on this website, including text, images, logos, and downloadable materials, is the property of Artfelt Therapy and protected by Indian copyright laws. You may not reproduce, distribute, or create derivative works without our written permission.

Art created during therapy sessions remains your property. We may request permission to use anonymized images for educational purposes, which you may decline.

10. User Conduct

You agree not to:

• Provide false or misleading information
• Harass, threaten, or harm the therapist or other clients
• Record sessions without explicit written consent
• Share session content or therapist communications publicly
• Use our services while under the influence of substances
• Violate any applicable laws or regulations

We reserve the right to terminate services if these conduct guidelines are violated.

11. Limitation of Liability

To the maximum extent permitted by Indian law, Artfelt Therapy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Artfelt Therapy and Divya Batra Masiwal from any claims, damages, losses, or expenses arising from your breach of these Terms or misuse of our services.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after changes constitutes acceptance of the modified Terms.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

15. Dispute Resolution

In case of any disputes, we encourage you to first contact us directly to seek an amicable resolution. If the dispute cannot be resolved informally, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Mumbai, and proceedings shall be conducted in English.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
